By using this website and the services provided by Happiness Balloon you (referred to as customer/you/your) are agreeing to the following terms and conditions listed below.
You acknowledge that any use of this website including any transactions you make using is subject to our terms and conditions.

Please ensure you have read these terms and conditions and our privacy policy, before using our website. Placing an order with us, it is deemed that you accept our terms and conditions and privacy policy:

The content on the pages of this website can be used for your general information and use only. It is subject to change without notice, please check this page regularly to keep up to date with changes.
Your use of any information or materials on this website is entirely at your own risk, for which we will/shall not be liable. It is your own responsibility to ensure that any products, services or information available through this website meet your specific requirements. 

Any unauthorised use of this website or reproduction may give rise to a claim for damages and legal proceedings may be issued. 

ITEMS
Please be aware we have provided accurate photographs, colours and offer descriptions of the items we sell on our website.
As colours can appear different depending on the device you are using to access our website, we cannot guarantee that your device will display an accurate depiction.

Happiness Balloon cannot be held responsible for any discrepancies.
Products may occasionally vary in size, shape, ratio or colour .
Images are for guidance only. We reserve the right to vary our prices, product images, product descriptions and website content as per required.

Re-use/copying of the materials on Happiness Balloon website is strictly prohibited unless written permission has been received.

All items are subject to availability. If an item is out of stock or we have an issue getting it on time, we will inform you straight away and you will be offered an alternative or the option to cancel with a refund for any items that have not been personalised, custom-made or are perishable.


PRICE, PAYMENT AND DELIVERY

All orders must be paid for in full before production takes place.

Price & Payments
Payment is accepted by credit/debit card or via PayPal. Cash payments are not accepted. All orders must be paid for in full before production. 

The price payable for the goods you order is as set out on our website in the cart at the time you place your order. Cancelation or modification to your order can be only done within first 24hrs of order, due to the nature of gift as some products are ordered and some will be personalised.
 
All prices are shown in AUD.

Delivery
We aim to deliver your order within 3 working days, subject to availability, unless you have specified that your order should be delivered at a later date. Please note: bank holidays and weekends are not included as “working days”. 

We offer delivery Adelaide-Wide. (Fees Apply)
We reserve the right to change at any time.

Requests for specific delivery times must be made and agreed in writing in advance, by emailing happiness.balloon.au@gmail.com 

It is the customer’s responsibility to ensure that all the details you give are correct at the time of ordering, as we cannot be held liable for issues with deliveries which arise due to incorrect names, addresses or contact information.
Redelivery requests which arise from issues such as these cannot be guaranteed; requests must be made in writing to happiness.balloon.au@gmail.com and paid for in advance at a fee set by Happiness Balloon.

Risk of damage to or loss of the goods passes to you at the time of delivery or if you fail to take delivery at the agreed time. Refunds and/or compensation will not be offered for balloons which deflate or pop after delivery has been made. Please ensure balloons are kept away from heat and out of direct sunlight as this will cause the balloons to deflate or pop. Please handle all balloons with care.

RETURNS
In the unlikely event that you are not satisfied with your purchase, please email us in the first instance, and within 24 hours of receipt of your order, at happiness.balloon.au@gmail.com to discuss the issue.

Refunds cannot be offered for personalised, custom-made and perishable items.

FORCE MAJEURE
We are not liable for any delay or failure to perform any of our obligations if the delay or failure results from events or circumstances outside our reasonable control, including but not limited to accidents, war, fire, industrial disputes or civil commotion, failure of any communications including telecommunications or computer systems, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and we shall be entitled to a reasonable extension of its obligations. 

DISCLAIMER: 
Warning:  ▪ Uninflated or broken balloons can cause choking or suffocation.
Responsible adult supervision is required. Discard broken and/or deflated balloons immediately. ▪ Wax products are hot when melted. 
▪ Food items may contain nuts and/or other ingredients which may cause allergic reactions.
▪ Please read ingredients on food/product packaging prior to consuming. If in any doubt of the ingredients do not consume the food item, a full ingredient list is available on request.
▪ Product may contain fishing wire/nylon/other product (to suspend and/or display items inside the balloon/hamper) which may be a choking hazard.
▪ Contains small parts. 
▪ Please ensure all baby garments and baby items are washed in accordance with the manufacturers’ instructions before use. 
▪ Please unpack the gift safely, ensuring all pins, bands, binding and other small objects are removed and carefully disposed of by a responsible adult. 
▪ Ensure all usage instructions on all items are adhered to. ▪ Please adhere to safety notices and age recommendations for all items. 
▪ Please keep balloons out of heat and direct sunlight as this may cause the balloons to pop. Please handle all balloons with care to avoid popping them.

Once the balloon has left the care of Happiness Balloon Premises and it is in the hands of the customer, Happiness Balloon is no longer responsible for the care of the balloon or if anything was to happen. (We pre-make balloons usually 24hrs before the order to make sure there are no issues with it.

If for any reason the customer requires a balloon to be remade, the customer will incur a fee of $35 for the Balloon + Personalisation or $25 for just the balloon sticker.
The customer will also be required to bring the balloon back to us and ALL of its contents back to Happiness Balloon to complete the service again.
Under no circumstance will we ne able to pick up the contents from the customer or the recipient. If you require a delivery again we will be charging a fee according to your destination.
